Health insurance

What happens if my ex is resopnsible

for providing health coverage and he

loses his job through which the plan

was provided? The divorce decree

states he must maintain the medical

coverage prodided by his current

employer for me and my children

according to the RI INSURANCE

CONTINUATION ACT. He recently

became unemployed at no fault of

his own. Is he required to pay out of

his own pocket?

Re: Health insurance

If it says "current employer" and he is not with his "current employer" AND there are no other provisions either in the Final Judgment of Divorce or a Marital Settlement Agreement about health insurance then there is nothing obligating your ex-spouse to continue the insurance.

Your ex-spouse can be required to pay monies out of pocket as a medical insurance contribution but you will have to return to court to get an Order for that contribution.
