You are entitled to make a legal claim to a portion of the equity that exists in the home that you bought during the course of your marriage. How much you would or should receive is arguable based upon all the circumstances of the purchase, your contributions during the marriage (both monetary and non-monetary).

Since the house was purchased during the course of your marriage, it should be considered marital property and subject to division by the Rhode Island family court. In this instance, it should not matter whether your name is on either the house, the mortgage or neither.

My very best to you during what can be a very difficult time and a very confusing process.
