Legal Question in Family Law in Rhode Island

Interstate Child Support

There was Child Support order that was issued in the non-custodial parent's state with the age of emancipation being 18. This order has been closed since the child is now emancipated. Can the case then be reopened in the child's state because the age of emancipation in that state is 21?

Re: Interstate Child Support

This is most properly an issue for a lawyer in the state which recognizes the emancipation at the age of 21.

However, I would be doubt that the state recognizing the emancipation at 21 would reopen child support case based upon Full Faith and Credit of Decisions recognized between the states. If emancipation was already declared for instance in Rhode Island with emancipation at the age of 18.

I would think any other state recognizing the age of emancipation as age 21 would give full faith and credit to Rhode Island's jurisdiction and emancipation Order issued at the time of majority in Rhode Island (Age 18).
