how do i leave

I am considering on leaving my husband. I have one child with him. I think for the children we have he has one from previous that lives with us i also have one from previous. HIs daughter has been starting alot trouble she refuses to go live with her mom but yet she thinks her moms the world. I can i ask HIM to leave so we can be seperated temp. if needed or even just to ask him to leave for a divorce? I don't know what to do. This has all cause alot of heartache in this house and my son is always crying because there is so much arguing. I don't want him around this anymore.

Are you considering leaving your husband or are you certain you want to leave him? Even if you have decided to divorce your husband, you can ask your husband to leave but he does not have to do so. Alternatives can be difficult based upon your financial ability to leave with your children or to retain a lawyer for a divorce. Even in a divorce one party will not be ordered to leave the home unless there is domestic violence.

You do not seem to be looking for a legal answer but rather a practical one. I have given you the legal alternatives but this does not solve your issues.

I can only suggest reaching out to family and possibly even friends during this difficult time to see if they can give you a place to stay with your children while you seek a divorce. Think this through and figure out what financial resources you have that you can use BEFORE you file for divorce. You may be required to make some very hard choices amidst all the arguing for the benefit of your son.
