Legal Question in Family Law in Rhode Island

I live in RHode Island and I am planning to relocate to Virginia for school and better housing prices. I have a 4 year old daughter and her father and I are still married but have been living seperate for 2 years now. He has seen her once since the seperation. I plan to file the divorce when I can save some money and I meet the new states requirements. Can I get charges with parental kidnapping if I move with her. Nothing at all has been filed in court yet not even a seperation. I have little contact with him but he is aware of my intentions to move
