Legal Question in Family Law in Rhode Island

I live in RHode Island and I am planning to relocate to Virginia for school and better housing prices. I have a 4 year old daughter and her father and I are still married but have been living seperate for 2 years now. He has seen her once since the seperation. I plan to file the divorce when I can save some money and I meet the new states requirements. Can I get charges with parental kidnapping if I move with her. Nothing at all has been filed in court yet not even a seperation. I have little contact with him but he is aware of my intentions to move

Your question is slightly unclear. Are you asking whether the father of the child can bring parental kidnapping charges against you under Rhode Island law if you move to another state with the child? Please clarify before I respond to your question.
