Motion to Adjudge

Do i have to wait for the state to file a Motion to Adjudge for past due child support?My Ex is about 2,000 behind in support.And has not paid for the last 3 months.

No. You may file a Motion to Adjudge in contempt at any time your your ex is behind in child support.

Keep in mind that it is best not to file such a Motion until your ex is more than 2 weeks behind on support payments. Since you are well beyond that point a Motion to Adjudge your ex in contempt is completely appropriate. Since the state represents the State's interests and not yours, it is best not to wait for the state to file the motion because the state's attorneys have quite a bit on their plate as it is.
