Pension distribution

I have recently divorced Both my spouse and I are in the state retirement system. I am confused as to how our pensions will be split. I am eligible to retire this year at 60%, however my ex-spouse is not eligible for approximately 7years. According to the settlement we are to split our pension distributions 50-50. However I am curious as to how my allocation from my spouse's pension will be determined. Will it be 50% of what he was eligible for at the time of the settlement( if he was to retire at that time -his pension would have been approximately 40% vs. 60%, as mine is.

Reread your settlement agreement. Then visit your attorney again. Maybe he/she will be able to shed some light on to what was discussed during the negotiations. He/she might also do some research on the law in your state on the subject of pension division.
