Can my new spouse' income be calculated in child support in Rhode Island?

Pursuant to Rhode Island child support law, only the biological parents income can be factored into determining child support.

However, The Rhode Island (RI) family

Court judge can go above the minimum child support guidelines based on a spouse's income. This is based on the theory that the spouse is contributing towards the expenses of the household.

The judge can use any factor that the judge believes is relevant and pertinant to go above the minimum child support guidelines.

Furthermore, if the biological parent decides not to wok and is being supported by their spouse then the spouse income can be relevant.

I recomend that you consult with a RI family law and child support law lawyer / attorney.
