Legal Question in Immigration Law in Rhode Island
reentry after deportation
In 2003 my now fiance was charged with a misdemenor drug charge. I met him in 2004 while he was undergoing court for the charge. I brought him to all his hearings in which they kept getting post poned. Then finally after over a year of that he was given probation and I believe community service. The lawyer that was appointed for him never sent the papers to him on where and when and who to report to. He was originally here on a visa but it had expired and we were planning our wedding but put it off due to me becoming pregnant. Then in april 2006 we had gotten into a small quarrel and the elderly people downstairs called the police due to him being to loud. The police said they were required to hold him for an evening due to rhode island law and domestics. Immigration jumped all over him because he had not reported to what he had to from the previous charge. I had the lawyer use my address and the papers were never sent, I found out when I called that she had left on maturnity leave and may not have had them taken care of. I have a 21 month old son that is his. Can I marry him in portugal? (Azores) Please let me know anything or everything I can do.

Of course you can marry him in the Azores but you need to talk with an immigration attorney to go over more facts and find out all your options. There are too many details in immigration law to rely on this forum for your future.
