Legal Question in Intellectual Property in Rhode Island
could you use a vehicle from a video game as inspiration for a real life design as long as you change the design a little bit or could you still get sued for copyright infringment?
1 Answer from Attorneys
The test for copyright infingement is called "substantial similarity." So it comes down to first is there sufficient creative expression? If yes, is your work substantially simillar to the original work?
