pre- employment references
I would like to inquire about whether a previous employer can say damaging and derogatory remarks to prospective employer. If we call and record a conversation with the previous employer, and they say damaging answers to our questions, can we take them to court and prosecute? I am having trouble getting hired at new jobs and was curious if my references were to blame. Thank you!

An employer is taking a HUGE risk in saying anything about a former employee under current law.
Check your state's laws, and if you can find a prospective employer willing to say what he was told, then maybe you have a chance of winning in court, but it's not an easy thing to prove. That's a better solution, I think than a self-serving sting.
