Legal Question in Employment Law in Rhode Island

Previous record

I had a felony drug charge about 4

years ago and served seven months.

After i was released I obtained a

college education and was hired to do

my dream profession. On my

application it never asked if i was

ever convicted of a felony. I have

been with this company over a year

now and I am doing a great job, not

to mention perfect attendence. Could

I be fired for discovery of this?

Congratulations on your achievements!

At present, RI law essentially permits an employer to fire an employee for any non-discriminatory reason or for no reason at all - your employer may fire you because you look at him crooked!

So unless you are covered by an employment contract - individually or collectively as part of a bargaining unit, like a union - an employer does not need any reason at all.

While I certainly would not advise you to volunteer information about a prior felony conviction, then, you need not lose sleep over it since your employer doesn't need any reason to fire you!

Perhaps the best things you can do for yourself are (i) live your life in such a way as to show that you're smart enough to have learned from your mistake, and (ii) make yourself as essential as possible to the employer!
