Legal Question in Landlord & Tenant Law in Rhode Island

Security Deposit Disputement Upon Moving Out

In Feb 05 I moved into an apartment with two 'friends'. I agreed to front them money for the security deposit and first months rent bc they didnt have any. I wrote the landlord a check for approx $2100 to cover both. Each of us signed individual month-to-month leases. After three 1/2 months in they made no effort to pay me back and I moved out, they moved another third party into my room. I amwondering if I am entitled to the entire security deposit back, or atlest 1/3 of it because I moved out. The other kid moved into my room for free basically, just picking up the rent where I left off. Or, do I have to wait until they all move out to get my money back. The landlord did not offer me even 1/3 of the money I gave him, and actually made some kind of comment that he isn't goin to pay back any security deposit until we all move out.

I would need to see the leases to advise you.

If it was truly an individual month to month, you should be able to get your deposit after you move out, but I suspect the lease language says otherwise. Most landlords would want to hold on to it until everybody is out and he determines there is no damage, and proper notice was given etc.
