Legal Question in Personal Injury in Rhode Island

My husband had a very bad stroke in March. While at the hospital he tried to get out of bed. They caught him and moved him to a room in front of the Nurses Station. While nobody was watching him he did fall out of bed on his head. He had t be rushed to another larger hospital for brain surgery.

He had an artery that burst.

Do we have any recourse on this? They had a warning that he was trying to get out of bed.....they moved him but nobody stayed with him. They could have put restraints on him for his safety. I will probably never know if the fall caused the artery to burst but I still feel that fall should never have happened.

You may very well have recourse against the hospital and its staff for failing to monitor your husband. However, medical malpractice cases are very complicated and very fact specific. Therefore, the only way to competently answer your question is after a thorough review of all of your husband's medical records.
