Hi, I have a Q on a certain situation. I was involved in a car accident. I was hit hard in the back of my jeep. It was witnessed by a police officer and was not my fault, as written in the police report. The driver was a delivery man for Firestone tires,it was not his car,nor was it officaly a company car for Firestone, but he was delivering tires to a local store on compant time, again noted in the police report.Problem: my insurance on my car ranout two months prior to the accident.I was injuerd, can I still collect agaist them?for damages to my car and self?also who do i contact to handle the legalities of this case.the manager contacted me and offered to write a check to me in cash but i dont really want to do this.I think he realizes the trouble he may be in.

Even though you did not have insurance, you do have a claim for damages against the owner/operator of the vehicle that hit you in the rear.
It may be that the manager of the branch does not want to report this matter to their insurance carrier.
In any event, you should seek legal counsel to assist you so that you can receive the maximum recovery for your injuries and property damage. Feel free to contact me at 401-885-7200 if I can be of assistance.

Hi, because you were hit in the rear, chances are
that you would not make a claim against your own
insurer even if you had insurance. Your damages
are the fault of the driver AND owner of the
vehicle that struck you from behind. If the
manager offered to write a check "cash," I can
assume that his offer was very low.
Because you suffered both car damage and
personal injuries, I urge you to call a RI attorney
who can properly assess the amount of your
damages and identify the proper party at fault.
