What happens if i refuse the frist settlement offer

I turned down a settlement for 12,ooo after i was hit and injured in a car accident, i had sever whiplash. musle spams(which still come and go) the other person has been deemed the person to have cause this accident. will the insurance company come back and make another offer, or is there something my lawyer can say or do to move this along. the limit in ri is 3 years. the amount they offered is an insult i would end up with about 200.oo after all the bills are paid off this would not cover my gas money just getting to treatments dr.appt. etc. what happens on my part if we have to go to court? thank you to anyone who can give me any piece of mind on this. the driver did not own the car and the owner only had 25/50 on the car.

Re: What happens if i refuse the frist settlement offer

It's possible that the insurance company may increase their offer if you are able to articulate facts and circumstances that would be considered by a jury when deliberating your case. However, they know that they are dealing with a layperson, so don't expect them to increase it very much or to do so in any hurry.

When insurance companies deal with attorneys, they know that the attorney knows the law better than they do. Things happen more quickly when an attorney is involved and settlement figures are much higher than those negotiated by laypeople.

In your case, more information would be necessary to adequately address your inquiry, such as whether there were any issues of liability and whether you carry uninsured motorist insurance.

If you are close to the 3 year statute of limitations, you should consult with an attorney as soon as possible, providing specific details about your case.

Feel free to contact my office if I can be of further assistance.

Best wishes to you.
