Legal Question in Real Estate Law in Rhode Island

keys

As a landlord of a property that I reside at, am I in violation of any laws if I have duplicate keys to all or any of the dwellings that I rent out?

Re: keys

There is no violation under the facts you presented - creating duplicate keys.

In fact, it is prudent and appropriate to retain keys so that you can enter in an emergency.

Any other entries must be at reasonable times and for an appropriate purpose, such as inspecting or repairing, but reasonable notice is required in the absence of an emergency.

Using your keys to enter for an inappropriate purpose -- such as merely "spying on" the tenant, etc. -- could result in civil liability for breach of the lease, and, depending on the circumstances, to criminal liability for trespass.

Please feel free to contact me at 401-885-7200 if I can be of further assistance.
