Legal Question in Wills and Trusts in Rhode Island

Before my Dad died of Mesothelioma, he got a lawyer and he "told" me all monies in his estate would evenly with my siblings, stepmother and myself. My stepmother took 60% and told us out of the goodness of her hart, she won't be taking the 20% and my brother just told me she made her niece her exec. and is leaving all her money to her niece and nephew's. I think I should sue her now, Scott thinks wait and see if see does the right thing, if not then sue her niece and nephew's.

I'm don't think there is a will, my stepmother has not let any of us in the loop and she is close to Scott, she never really liked the rest of us.
