Legal Question in Wills and Trusts in Rhode Island
How do I go about giving someone power of attorney? Do I need an attorney to do this?
1 Answer from Attorneys
A form of power of attorney for health care is available on the Attorney General's web page: http://www.riag.ri.gov/documents/reports/healthcare/power_of_attorney.pdf. You do not need an attorney to complete this form.
A general power of attorney (sometimes referred to as a financial power of attorney) is more complicated and I recommend that you engage an attorney. While there are many forms available on the internet, most available for purchase for $25 or less, they may not address all the possible situations you need handled. You should talk to an attorney who can determine which form is best for you - there really isn't a one-size-fits-all form. Different situations require different language. An attorney should be able to draft a simple power of attorney for between $50 - $100. Please feel free to call me for additional information - 401-996-3247.
