Legal Question in Wills and Trusts in Rhode Island

If a trust is passed from a husband to his wife, 50 years ago. She and her family lives off of this money for the next 50 years and she passes away, however she didn't change the name on the trust or stipulate in her will that this trust was part of her total assets. Does this money go to the original beneficiaries on the husbands will which stated that when she passes it goes to the children, or is it included as the wife's assets and now goes to the different beneficiaries in her more recent will?

Please help!,

Harmony

The trust document itself will specify what happens to the trust corpus - the remaining principal - once wife dies. So you need to review the trust document itself to find your answer.

For your information, LawyersCollaborative offers as a community service a Limited Engagement where one of our Staff General Counsel will spend up to an hour meeting with you (to review documents, explain procedures, and otherwise help you), for a fixed fee.
