Legal Question in Bankruptcy in South Carolina
Chapter 7 Trustee seeking judgement for dividends.
I have been in Chapter 7 for almost 2 years. The trustee wants to place a judgment on me for disbursements received over a 5 month period totalling 16,600. They sent a letter which myself and the company i owned at the time never received. They sent it to a mailbox we dont use. In October we were ordered to stop disbursements which we did and broke up the company as it was in debt. The Chapter 7 trustee is now asking for $16,600 from me in a judgement and to stop dischage. I am making less money now then before I filed. I have lost my car, house, business and am self employed. I do not have $16,600 to give the trustee, what can the court do.

This is a serious matter. You were required to keep a current address on file with the Court and your attorney. Your attorney really needs to assist you in resolving this matter. There is no simple answer. There should have been a hearing and maybe even a Section 2004 examination. Someone will need to review the file to see what has transpired, ASAP.
