Legal Question in Consumer Law in South Carolina

Mobile Home dealership lied!!

Last year we had our home foreclosed on and found ourselves in need of a place to live. We happened upon a Mobile Home dealership just to look and dream as we knew our credit was now ruined and could never get a home financed. When the salesman came to talk to us we told him we were just looking and told him we knew we couldn't get financed. He then explained what he called the ''Buy for program''. Meaning that we would use someone else's credit for one year and at the end of that year the home would go into our name. To make a long story short...we did the program and a year has past, the finance company now says they know nothing of a buy for program. And the person who helped us for the year wants out of the contract like he was told he would be and we want the home in our name....Help please.....

Re: Mobile Home dealership lied!!

This seems to be a problem in the housing industry these days. The sellers use a third parties' credit to make the sale and misrepresent to the parties that the purchaser can refinance after a year or the home will automatically go into the purchasers name after one year. Usually the Seller denies any knowledge of such a program when everything hits the fan. Also, none of this is ever in writing and it is hard to prove. These type of tactics probably violate the Credit Repair Oganizations Act which makes it illegal for a company to engage in credit repair without complying with the Act. Also, it probably violates the South Carolina Unfair Trade Practices Act. You may want to contact the South Carolina Department of Consumer Affairs and the Federal Trade Commission and file a complaint. You can also contact an attorney and file suit against the Seller for fraud, violation of the South Carolina Unfair Trade Practices, violations of the Federal Credit Repair Organizations Act, Negligence, and other theories. I have been involved in number of these type of cases lately.
