Legal Question in Credit and Debt Law in South Carolina
collection agency
I settled credit card debt with Gerald E. Moore & Associates in 2005, cannot get in touch with them since. Now receiving credit card collections on same account from Midland Credit Management with excessive harrassing calls and threats to collect debt. In research to get in touch with 1st collect agency to get proof of paid in full have found all kinds of information on Gerald E. Moore and associates and the Midland Credit Management group. I am sending MCM a letter in my findings and disputing the account, is there any thing else I can do to stop this?

Re: collection agency
Yes - you can and should consider filing suit under both federal and state law to seek an injunction and possibly statutory/actual damages (if appropriate), if a collector is attempting to collect an uncollectable debt. Debts that have been settled or paid in full and which are later the subject of collection attempt are called "zombie debt" - they keep coming back like the undead. Speak to a consumer lawyer as soon as possible to avoid prejudicing your rights as a consumer.
