If someone has a debt with a small retail store that issued them a credit card for their store and the consumer only charged $120.00 and was making monthy payments and then had a dispute with late charges and was told that they would be removed but was never removed and then the consumer stopped paying after they had payed what was owed for the items bought plyus interest less the late charges which to date is over $400.00 and this debt was incurred over a year and a half can legal action be brought against the consumer or does it just go against your credit history???

Yes, they can sue you in magistrate's court. Will they? Who knows? For such a small amount, you may elect to simply pay it off, or you may want to speak to a lawyer about fighting the debt. If you go it alone, which is definitely a possibility with such a small amount, just make sure you document everything in writing, especially if discussions are held over the phone, and keep copies of ALL documents.
