Legal Question in Credit and Debt Law in South Carolina

Debt collectors calling family

My wife has a debt with a bank in canada. She for the most part makes the payments on time. But recently they have been contacting us asking for the next payment almost immediatly after the last. Calling us on a daily basis. They recently been calling my parents who live in South Carolina, when we live in PA. Now they call my parents several times a week asking for us, when neither one of us live there. Is this even legal? Or how can we stop this type of harrassment?

Re: Debt collectors calling family

An original creditor can contact anyone they like in an order to locate a debtor. Once they have a current and accurate address and/or phone number of a debtor they may not contact another party in an attempt to harrass. And when contacting the other party they must not disclose any information that they are attempting to collect a debt.

An original creditor has wide latitude in order to collect legitimate debts.

If the debt is being paid in a timely manner and is currently up to date then call and speak with a senior manager to complain. Also, writing a letter to a senior executive (CEO, COO) may also help.

There are legal options to pursue but tend to be more difficult and expensive to press against an original creditor.
