Legal Question in Credit and Debt Law in South Carolina

can i be sued for a civil suit

I had a credit card that i forgot i had in 2004, the card was used only once. Today i got a called from a collection agency that informed me that there was a $1700 debt on the card, and that the card company was filing a civil suit against me. I then pulled up my credit report and got the card number off of it. They told me that they did a charge off on my credit report. My question is can i really be charged with a civil suit? I am a little confused about the whole situation especially if the company charged it off on my credit.

Re: can i be sued for a civil suit

Charge-off is purely an accounting technique that works to clear the creditor's internal books. It does NOT alleviate you of the responsibility to pay the debt.

However, there may be other defenses to the debt, and so you should definitely (A) NOT ignore any documents you receive and (B) speak to a consumer credit lawyer pronto. Good luck!
