Legal Question in Criminal Law in South Carolina

When I was 17 I was convicted of shoplifting a bottle of make-up for my high school graduation. That was June 6, 1986 went to court on July 28,1986. I was fined $66 and the judge said that if I didn't get into any trouble before I turned 18 that my record would be sealed. Now that I have applied for a job at our local Hospital it is showing as a conviction on my SLED report. What can I do to get this taken care of? I've been to the city where I was arrested and they said it would take 3-4 days to hand search this because it was so long age. How can I speed up this process I need those court records by Thursday Sept 10, 2009?

I'll give you several suggestions on what you can do. I do not know how quickly any of this will take. But hopefully with these suggestions you might be able to speed things up.

You can directly contact SLED. They have a process for an individual to obtain thier criminal history. If you go on the SLED web site and look in the column on the left, you will see a category entitled Criminal Records Check. It outlines the process for obtaining your criminal history. I personally have not read this section, so I don't know exactly what they outline for the process, nor how long any of it takes. But if your in a hurry, you can call them at (803) 896-7056 and ask to speak with someone who handles Criminal Backgrounds and maybe they will have an idea on how you can do this as quickly as possible. You can even ask if going to thier office would help.

Another thing you might be able to do is to call your local County Solicitor's office. In South Carolina the Solicitor's office is the ones that handle Expungements.

You can also try contacting a local attorney and see if they have any ideas on how to get this done fast.

Another possibility is if you had an attorney that represented you, you could always try contacting that attorney and see if he/she still has your file. Maybe there would be something in there that would help.

You said that you've been to the "city" where you were arrested. I assume that you mean you went to the "court" where you were convicted. If you have not contacted the court, then that would a good thing to do.

I hate to tell you this, but I really don't think you will get this resolved as quickly as you want to. But hopefully with these suggestions you can at least get the process started. If you have any questions you are free to call or email me and I'll try and help answer whatever questions you have.

Now, I was wondering if you could do me a favor. Your message said that you need those records by Thursday, September 10th. That concerns me because I did not receive your question until today, September 13th. Would you please do me a favor and email me back and tell me when you submitted your question through this site? I'd like to know how long it took for me to receive it.

Thank you,
