Legal Question in Criminal Law in South Carolina

My sons father was charged with abhan. My son peed in his brother closet on accident and his father over reaccted and hit him in the face and left a mark.. my mother called the police to save me from having my kids taken away. I have tryed to drop all charges but they tell me that i cant cause im not the victim. I would like to know what is the longest he can be sentenced.

ABHAN, which is Assault & Battery of a High and Aggravated Nature, carries -0- to 10 years. However, that doesn't mean that he will get jail time. That is simply the potential jail time. There are basically three different Assault and Battery charges in SC. One is Simple Assault and Battery, then there is ABHAN, then there is one that is the most serious. On occasion, they will reduce an ABHAN to Simple Assault, if its not real serious and if the defendant doesn't have a bad record. That might be a possibility in this case since you said that all he did was just hit him. Do you know what county this is in? Robert Johnston
