If accused of a crime but no proof can you still get charged by the judge?

I'm not sure I understand your question. Part of the arrest process in a lot of criminal cases is that a judge can sign an Arrest Warrant. In order to do that, someone needs to provide the judge with enough information for Probable Cause for the arrest. That does not have to be a lot of evidence, but there must be "some" evidence.
