Legal Question in Criminal Law in South Carolina

Arrested and Jailed without having been read my rights

Myself and two others were arrested in SC without having been read our rights and we was jailed for 22hrs. Can we get out of the charges. I have four citations all totaling $1863.00 for open container, public intoxication, with holding information to a law enforcment officer and urinating in public. I was never asked any question so how can I be charged with with holding info if the officer never asked me a question, he only asked me to put my hands behind me to arrest me.

Re: Arrested and Jailed without having been read my rights

The police do not have to read a person their rights. What the law says is this. If they are going to use any statements against you in court, then they must read you your rights. Many people are arrested without their rights being read to them because the police don't think any of the defendant's statements are important. As far as withholding evidence, based on what you have said they may not have a case. I assume you two were given blue tickets for your charges.
