Trying to get the attention of a driver to pull over

Being a new resident in South Carolina, I am not familiar with their laws. I had to get a wrecker to tow my vehicle and when he drove off with my car, I realized he had my keys with my house keys on the ring. I proceeded to catch up to him to get him to stop and pull over just to get my house key but he wouldn't. Three days later he filed an assault charge on me for trying to pull him over and I was arrested and charged. I did not know there was such a law and I was only trying to get my house keys. I am scheduled for court this month. What should I do and is there a chance I could get it thrown out?
