How do you avoid jail time once being charged with DUS 3rd?

One way is to get it reduced to a Second Offense with a fine. Another way is what I do as an attorney. I submit a Discovery Request to the prosecution which requires they provide a copy of the previous Notice of Suspension. That is a requirement for prosecution of a DUS. If they cannot provide it, then I make a motion for the charge to be dismissed or sometimes reduced to a lessor offense and that keeps the person from going to jail. Your best bet is to hire a lawyer.
