Legal Question in Criminal Law in South Carolina
How do I take care of a SC warrant if the police will not extradite from Florida?
1 Answer from Attorneys
You haven't explained much, but I'm assuming you live in Florida and you want to some how resolve the warrant you have in SC, without coming to SC. That is hard to answer without knowing much more about the case, such as what the warrant is for, if there is a victim, if money a fine or resitution is owed, how old it is, etc.
If they won't extradite you, then that leads me to believe that its not for a real serious crime. In certain circumstances an attorney can get the details, speak with the police, prosecutor or court, and find out how it can be resolved. In some cases, warrants can be taken care of by paying the fine or otherwise complying with some previous court order. In other situations, the persons must appear in SC and have the warrant served on them.
Right now, I have no idea if its an arrest warrant, bench warrant, if its old, for a felony or a misdemeanor, or for not appearing in court, etc. You just haven't provided enough information.
Best thing you can do is contact a SC lawyer in the county where the warrant was issued and go from there.
There is no clear-cut answer to that question this soon. It all depends on many things, such as how much medical treatment you need, its cost, lost wages, your medical prognosis for the future, whether you need or get surgery, physical therapy, etc. Some people heal quickly with little medical treatment and others don't. Each case is different.
