Legal Question in Criminal Law in South Carolina

I was charged with exploitatin of a vulnerable adult and it was dismissed in July 2011 and picked up by the Grand Jury. Now that I have been re-indicted for the same charge and one additional - failure to report exploitation of a vulnerable adult - do I have a right to another preliminary hearing?

Its a little hard to completely answer your question, since you didn't say what happened to the first Preliminary Hearing. However, since you said that there is an additional charge, then you should be entitled to a Preliminary Hearing on that one. Whether or not you could still invoke your right from the first charge to have a hearing would depend on what happend the first time around. Everybody is entitled to a hearing on those types of charges. Ask your attorney to request the first charge to be joined with the second one for the hearing.
