Legal Question in Criminal Law in South Carolina

Check Cashed for Wrong Amount

I just got a call from a convenience store. They cashed a check for one of our employees and claim to have drastically overpaid the amount. They stated they have the transaction on recorded video.

Now I know this fellow and can state with some certainty that if their claim is 100% true that he will:

1) Not have a single penny of that money left on Monday.

2) Dispute any overpayment made to him.

He has a criminal record for both drug and alcohol abuse, so he's exactly what you'd call respectable. Will he likley be arrested, and if so, what are the charges going to be and likley penalty?

I've got a feeling it's time to look for a replacement...

Re: Check Cashed for Wrong Amount

Your didn't say how much he was overpaid, or if he counted it on the spot, or if the check was altered, etc. Without further information its hard to say whether or not he would be arrested. However, I can tell you that if I was an investigating police officer and I was convinced that he did not intentionally cause the over payment, I personally would not have him arrested. Wish I could tell you more, but I don't have enough information to work with. Good luck.
