Criminal Domestic Violence

How can I get my CDV charge

dismissed. I'm in Spartanburg,

South Carolina. My wife is not

pressing charges nor did she write

anything at the time of my arrest. I

don't have a job; I have no income

what-so-ever and the PD office is

demanding I pay a fee in order to

receive counsel.

The victim of a CDV does not "press charges," in South Carolina. Its up to the state to prosecute. In order to get a case dismissed there must be a legal reason for it, such as Lack of Evidence, lack of Probable Cause, etc. If you are represented by the Public Defenders Office, then you have competent counsel and you would be best served by posing your questions to them.
