about criminal and domestic violence of a high and agrivated nature

A man is charged with criminal and domestic violence of a high and agrivated nature on his girlfriend, who provoked him. She will not press charges but the state continue to do so. The man sufferd a very serious traumatic brain injury 12 weeks before, that affects behaviour and is not recoverd. Will the court take into consideration his medical condition? and is there a chance that the case could be dropped all together?

I cannot tell you whether or not the case will be dropped since there I know nothing about the charges, evidence, etc., other than the fact a person was arrested. As far as the brain injury, its possible that could lead to a defense or a mitigating factor. However, I still do not have enough information to advise. Good luck.
