Criminal Domestic Violence 3rd offence
I would like to know what the sentence is for being convicted of CDV3? If someone takes a guilty plea for CDV3, what would the sentence be? Can CDV3 be sent back to Magistrates court? Can you seek a pardon from the County's Solicitor or work out a deal with him/her? If not, can you contact the state's Senator or House of Representative for more help. The CDV3 is not of high and aggrevated nature. Just threats. Thanks!

If the previous two convictions were in the past ten years, then the sentence is 90 days to three years, with the 90 days being mandatory. It is impossible to tell you what the sentence would be without knowing all the facts of the case, what the solicitor and defense attorney would present to the court and what the victim would say to the judge. The County Solcitor cannot give a pardon. Often in these cases a deal can be worked out with the Solicitor.
