Legal Question in Criminal Law in South Carolina
Due process
Crime in sc: defendant in montana: stopped for a traffic violation, told was wanted in sc for kidnapping, sc did not want to arrest: said they would call back if pursuing: defendant did not hear from them & assumed they made a mistake. Three years later stopped for a traffic violation in montana, sc decided to arrest & have him extradited. Didn't this delay which caused the defendant to gather his evidence to prove he was somewhere else, paper trail gone. Does this not violate his due process of defending himself.

Not likely. You may want to seek counsel.
