Legal Question in Criminal Law in South Carolina

expungement

I had a charge of simple possession about 10 years ago and I thought that it was supposed to drop from my record after 10 years, how do I go about getting my record expunged here in the state of South Carolina? will I need a lawyer?

Re: expungement

Only driving offenses are automatically removed from your record after 10 years. Simple Poss. of Marij. is not a driving offense. Having something expunged is handled through the county's solicitor's office in the county where the conviction took place. There are some forms that need to be filled out and there is some cost to this. Some people are comfortable with the forms and the process and some people are not. You can call the county's solicitor's office and discuss all of this with them. You can also contact an attorney if you would like to hire someone to do it for you. Good luck.
