Legal Question in Criminal Law in South Carolina

Federal or State Is This Legal?

How is it that, it is legal for the arresting officers in a(drug case)be able to hold on to property that was seized . And ,especially when the case isn't even state but federal. Is it legal for and officer to seize property while they are only suppose to be serving an arrest warrant, And then come back a day later and serve a seizure warrant for the property ?

Re: Federal or State Is This Legal?

There are very involved and complicated forfeiture laws as they pertain to drug arrests and certain other crimes. It is difficult to answer your questions without knowing more specifics of the particular arrest(s). I would suggest that you contact an attorney to discuss this. In case there are any time-frames involved in retrieving the property, I would contact an attorney right away. Robert Johnston 843-828-1137
