Wants Felony Expunged.
Hello,
I received a misdemeanor charge for personal property damages -in SC- around 1999. I was ordered to pay restitution for the damages I caused. I paid all of the restitution except the last 200 dollars; which I mailed to the wrong court by mistake. I was charged with a felony due to this simple mistake. My question is am I eligible for expungement under SC law;If so what steps do I take to destroy this charge? I have one prior conviction of insufficient funds in a checking account around 1986-87. Also, if it means anything I have been living in NC for the last 11 years. I live my life as a law abiding citizen and I am the grandparent of two. This experience has ruined my ability to live a comfortable life and I truly don't deserve this label. Please help!!

This is a little confusing. If a person does not pay court ordered restitution, then that usually results in them being found in contempt of court, or possibly in violation of their probation. It does not result in a new criminal charge. But in any event, only misdemeanors can be expunged and they must be a first offense. The Solicitor's office for each county is the agency that processes expungements. You can call them and they should be able to answer your questions.
