Felony Malicious Destruction of Property

I am being charged with Malicious

Destruction of Property over $1000.

I have currently been offered a plea

bargain of only paying restitution

and probation, however I am

graduating college soon and would

like to not have such a charge on

my record. I've never been in

trouble before and I'm wondering:

A) should I be able to enter a pre-

trial intervention program? or B) is

it possible to request a lesser

charge (i.e. a misdemeanor

malicious destruction charge, pay

the same restituion) in order for my

plea?

Two good questions. Your smart to not want that on your record. If you don't have any other convictions currently on your record, then you qualify for pre-trial intervention. However, that is a referral program and requires the solicitor to refer you to the program. It is also possible to go into the PTI program and still pay restitution.
