Legal Question in Criminal Law in South Carolina

My fiance` has been in jail since Nov. '09, He gave this woman a ride and in return she solicted him for money. The act started but stop. She told the police the she was rape. She went to the medical examiner and the found nothing. His lawyer (public defender) said she didn't have any information on the case. Now that she has evidence she have not went to court yet. I would like to know why is it taking so long for them to go to court if there is not DNA present? He has already had his first and second appearance.

I cannot tell you for sure why this particular case is taking so long. But I can tell you that the courts in this area (Horry County) are extremely busy and have more cases than they can handle. Your boyfriend might want to consider retaining a private attorney who can give this case some immediate attention. The public defenders are all good lawyers. The only problem is that they each have too many cases.
