Legal Question in Criminal Law in South Carolina
filing a false report
My friend is in a bitter divorce battle. His wife filed a false report stating that she was assaulted by her husband in an attempt to sabotage him. He was subsequently arrested at his place of employment and charged with assault and battery with intent to kill. He was suspended from his job (as a university professor) for an undetermined amount of time with 6 weeks pay. The mug shot and a copy of the filed charges were posted in our local paper the next day. The wife now realizes she has done something illegal (she is foreign) and is trying to recant the report, but it is ultimately up to the solicitor. What can he do?

Re: filing a false report
He should immediately hire a criminal attorney to assist him to gather evidence that he was falsely accused to present to the solicitor.
