Legal Question in Criminal Law in South Carolina
I went on a fishing trip with three others. We obtained permission to exit the river from a landowner. Two of us had been drinking and decided not to drive out that night. We were awakened in the night by an officer and the landowner. We explained the situation but were cited for simple trespass under SC code 16-11-600. Is this appropriate?

Its hard to say if it was an appropriate citation or not. I am very limited as I can only work with the information provided and there isn't much to work with. You said that you were given permission to "exist the river." But you didn't say if you were given permission to remain on anyone's land. If you were simply sleeping in your truck because you were drinking, then I think its a shame that you would be punished for that. In any event, I can't tell from the information I have to work with if the citation was proper or not.
