Legal Question in Criminal Law in South Carolina
Indictment
6 months ago I was arrested for disorderly conduct in my own backyard after opening the gate and coming out from behind my privacy fence. I was extremely intoxicated and did not realize that cops were standing outside my fence, all I saw in a drunken stupor were the silhouettes of persons standing there, they never announced themselves as officers and never pulled up with lights on. I sincerely thought that it was someone prowling around my house, I did not have a weapon so I was trying to itimidate whomever was there to leave by telling them that I would kill them by shooting them. They would not move so I eventually opened the gate and was immediately arrested, after realizing that it was cops I apologized and was charged with disorderly conduct, the next day the officer said there were no hard feelings. Now because of recent things between me and my neighbors and the officers having to come out again, they say that they are going back and try to get an indictment on threatening a public official. Is this possible?

Re: Indictment
Yes it is possilble. They can come by months later and get an indictment. In certain circumstances, they can do it a year or more. If you want to call I can give you some information that may help to protect you through the arrest process. Robert Johnston
