Re: Judgement

I assume that either the car was repossessed or you voluntarily returned it to the creditor. If you were having problems with the car and that was the reason that you refused payments, and the car was surrendered or repossessed, then you may have action against the seller for breach of warranty. Also, the creditor may be just as liable as the seller under South Carolina Consumer Protection law, up to the amount of the loan. If you do nothing and let the 30 expire, then you will have a judgment entered against you and it will attach to any real estate that you own in the county where the judgment is filed. Also, they can turn the judgment over to the sheriff to seize certain property that you own to satisfy the judgment. The judgment will also accumulate interest at 12%, so it will get bigger. I would retain an attorney, and discuss the matter with him or her, because often these matters can be settled for pennies on the dollar.
