leaving the scene of an accident resulting in death

20 year old NY resident attending school in SC driving from MacDonalds on Hwy 501 with a buddy (no drinking no drugs), hit ''something'' less than one mile from apt. Went to apt. Called police from apartment. Offered to go backto scene. Police told him to wait at apt. Several people have come forward to state the woman hit and killed was trying to get hit that night.

I do not usually restate other attorney's advise verbatim but you need to get this person a South Carolina Attorney immediately if not sooner. Find one extremely qualified and do not let money decide who the attorney is, find one who is the best.

In the South, accidents resulting in death committed by someone from outside their area are attacked with a vengence.

Your nephew needs an attorney right away. These cases are very complicated and there is always the potential for homicide charges being filed down the line. If this happened in South Carolina then you need to retain a South Carolina criminal defense attorney to advise you on the law as it varies state from state.
