leaving the scene of an accisnt resulting in death in South Carolina

under what circumstances can you leave the scene to make a call to thwe authorities. My nephew left the scene, made a call to the police but was arrested even though the statute states otherwise. Is there case law precedent?

It would be a lot easier to help you if I knew more about what happened. How many other people were involved in the accident and were other's injured? Was your nephew injured? Would medical assistance to the deceased have made any difference? Clearly it was not the intent of the statute to punish a person for going to call the authorities.
